 The legal question: Can AI copy your content?

There’s a big debate going on right now. Is it legal for AI to train itself on your content and use it to generate other content or answer questions?

Nobody has a doubt that human beings have the right to do this. To grok content and to use the understanding in any way you want, including preparing other content, specially if the original is referred.

Machines? There’s no clear answer. An AI bot can understand volumes of content in one go and then serve hundreds of thousands of users single-handedly. A human being cannot.

This is an interesting problem then. If it is principally okay to do what humans have done with data, then AI should be able to do it too. That’s the argument that OpenAI and others are making.

It’s public data, open to everyone, so AI should be able to consume it and train on it.

The thing is, while it benefits the publisher and the creators when human beings consume data, it hurts them when AI does. If you are writing a blog, having human readers read it and be influenced by your content is your objective. Having AI read it and use it without any reference to your blog is not.

That’s why publishers have been pushing back and with that regulations have begun to emerge. Governments in Europe are ready to implement the AI act which will limit the reach of AI.

Corporations who use AI to make decisions will have to be transparent about it, and they will have to make sure that the systems they deploy do not allow biases to creep in.

Content creators will have to be transparent when content is created by AI. It’ll have to be presented clearly.

Although this hasn’t even yet been approved and it hasn’t come to the shores of USA yet, the AI companies are waking up.

- YouTube will clearly mark videos that have AI generated content (audio or video)

- Meta will clearly mark images and other content that is generated by AI.

Most AI content creation systems will not start watermarking their content to clearly identify that it’s AI generated.

Audio, Video, Images… It’s coming to everything.

It’s going to be harder and harder to create content with AI and present it as human-generated content.

It’s going to be harder to take content from human creators and present it as human-generated content.

Sure, it will take nothing away from AI’s reach and potential, but it’ll be clear what is AI and what is not.

Does that affect you? Probably in a positive way. I will keep an eye out and update you when there’s something that needs mentioning.
